Judge Rejects DOJ’s Unsigned Amended Complaint Against Ex-FBI Officials
The attempted obstruction charge against Nikki Floris and Bradley Benavides failed. Their original prosecution continues.

U.S. Magistrate Zia Faruqui rejected an unsigned amended complaint against former FBI officials Nikki Floris and Bradley Benavides on October 27, AP reported. Prosecutors had filed the new obstruction allegation without judicial approval.
The original October 20 affidavit, signed by FBI agent Byron Militello, alleges false statements in the officials’ 2023 congressional interviews about Hunter Biden investigations. It cites internal communications to challenge their accounts of what they knew as Foreign Influence Task Force leaders.
Defense lawyers disputed whether the officials knowingly gave false answers about events years earlier, according to AP.
Testimony continued Wednesday; the agent acknowledged inaccuracies in the original affidavit. Prosecutors defended their good faith, The Washington Post reported.
